DATA PRIVACY POLICY
GTREES is a non-profit Ecuadorian collective model dedicated to the management and traceability of Waste Electrical and Electronic Equipment (WEEE), in compliance with the Organic Law on Personal Data Protection, current environmental regulations in Ecuador, and Ministerial Agreements related to post-consumer management of special and hazardous waste, including Ministerial Agreement 067, which regulates integrated and collective management systems to ensure proper collection, transportation, treatment, and final disposal of these wastes.
To ensure user trust and transparency in handling personal data, GTREES establishes the following Data Protection Policy:
1. Privacy and Consent:
a) Personal data requested (name, email, address, phone number) will be used solely for contact purposes related to WEEE collection and traceability requests.
b) The GTREES app or digital platform will request explicit consent to access geolocation data and capture photographs of managed waste.
c) Transporters, authorized operators, and associated collection points will be clearly informed about the use of location data and photographs, solely for ensuring WEEE traceability.
2. Appropriate Use of Background Location:
a) The app will use background geolocation and image capture only to ensure compliance with WEEE collection, reception, and delivery routes.
b) The use of this information for other purposes, such as advertising, commercial profiling, or unnecessary data collection, is prohibited.
3. Data Storage and Protection:
a) Personal, location, and photographic data will be securely stored in encrypted authorized servers with restricted access.
b) GTREES will implement technical and organizational security measures (encryption, access controls, secure backups) to prevent misuse, loss, or alteration of information.
4. User Transparency and Control:
a) Users can review and modify privacy settings related to location and photo capture within the platform.
b) GTREES will clearly inform users on how to revoke consent and disable access to location or image data.
5. Compliance with Laws and Regulations:
a) GTREES will comply with Ecuador’s Organic Law on Personal Data Protection, current environmental regulations, and other applicable data protection laws.
b) Continuous monitoring of regulatory changes will ensure privacy policies are updated as needed.
6. Data Retention:
a) Personal, location, and photographic data will only be retained as long as necessary to guarantee WEEE traceability and in accordance with environmental regulations.
b) Data will then be securely and permanently deleted unless legal obligations require longer retention.
7. Information and Notifications:
a) The platform will provide accessible and updated information on data use and purposes.
b) Users will be notified of significant policy changes, and new consent will be requested if necessary.
8. Use by Third Parties:
a) When sharing data with authorized operators, regulatory entities, or environmental authorities, contractual agreements will ensure the same level of data protection.
b) GTREES will not sell users’ personal information nor allow its use for purposes unrelated to WEEE management and traceability.

ELECTRONIC SIGNATURE USE POLICY
Purpose:
Establish guidelines for the secure and responsible use of electronic signatures within the GTREES system, ensuring legality, integrity, confidentiality, and authenticity of electronic documents, in compliance with the Law on Electronic Commerce, Electronic Signatures, and Data Messages and other applicable regulations.
Scope:
- All internal and external users requiring electronic signature use in GTREES-enabled processes.
- Electronic procedures, authorizations, approvals, and validations within the system.
- Electronic documents generated, signed, and stored on the platform.
General Provisions:
- Electronic signatures in GTREES are solely for validating and authorizing internal and external electronic procedures, ensuring legality, integrity, confidentiality, and authenticity of documents generated on the platform.
- The system allows users to register their digital certificate in an authorized format, stored only in an encrypted, protected path inaccessible to unauthorized third parties or services. This file cannot be visible, transferred, or replicated outside the secure system environment.
- The private key or password associated with the electronic signature certificate is not stored by the system. Each time a signature process is required, the user must manually enter their key, which will be used temporarily in memory and immediately deleted afterward, leaving no trace.
- The electronic signature service provided through GTREES operates in a controlled, secure, and temporary environment, as per applicable law. Private keys, passwords, or certificate content are never stored, transferred, replicated, or backed up.
- The use of the electronic signature is strictly personal and non-transferable and is fully the responsibility of the certificate holder. Any misuse will be considered a violation of this policy and may be subject to review and sanction according to GTREES’ internal information security and compliance regulations.
